Fitable Terms of Service

These Terms of Service for HakoPita (hereinafter referred to as “these Terms”) set forth the conditions for using the application “HakoPita” (hereinafter referred to as “this App”) provided by the operator of HakoPita (hereinafter referred to as “we” or “our company”). These Terms apply to all individuals who use this App (hereinafter referred to as “Users”).

Article 1 (These Terms)

  1. These Terms apply to all relationships between Users and our company concerning the use of this App.
  2. The privacy policy and any notices related to this App separately defined by our company constitute a part of these Terms.

Article 2 (Use of This App)

  1. Users shall download this App from the designated application distribution sites (App Store or Google Play), install it on their devices, and use it after agreeing to these Terms and the privacy policy.

Article 3 (Contents of This App)

  1. This App provides a function that allows Users to cross-search products from e-commerce sites such as Rakuten, Amazon, and Yahoo, as well as physical stores like Daiso, MUJI, Nitori, IKEA, and Cainz, based on the size information entered by the Users.
  2. We may display advertisements within this App. By subscribing to a paid plan, Users can hide these advertisements.
  3. In the free plan, some search functions have usage limitations. By subscribing to a paid plan (monthly or yearly), these usage limitations are lifted.

Article 4 (Service Fees, etc.)

  1. The basic functions of this App can be used for free. However, there are paid plans available, and Users who subscribe to these plans shall pay the fees specified by our company.

Article 5 (Suspension of This App, etc.)

  1. If we recognize that a User is likely to violate any provision of these Terms, we may, without prior notice, suspend the provision of this App to the said User and revoke their usage rights indefinitely.
  2. We may, without prior notice, suspend the provision of all or part of this App in the following cases:
    • a. If a malfunction occurs in this App.
    • b. If there is a defect in the computers, communication lines, etc., of our company or the businesses we partner with.
    • c. If our company or the businesses we partner with conduct system inspections or maintenance.
    • d. In the event of force majeure such as power outages, earthquakes, or fires.
    • e. Other cases where we deem it necessary.
  3. We shall not be liable for any damages incurred by Users due to such suspensions or interruptions.

Article 6 (Ownership of Rights)

  1. The copyrights, trademark rights, design rights, and all other rights related to this App belong to our company or the legitimate rights holders who have granted rights to our company.
  2. Users shall not, without our company's permission, use, divert, reprint, or reproduce any information related to this App.
  3. Users grant our company a free license to use all information registered on this App, including the rights under Articles 27 and 28 of the Copyright Act, and shall not exercise their moral rights of authorship.

Article 7 (Disclaimer)

  1. We shall not be liable for any damages incurred by Users in relation to the use of this App, except in cases where there is intentional misconduct or gross negligence on our part.
  2. We shall not be responsible for any consequences arising from errors in the information entered by Users.
  3. If any provision of these Terms is determined to be invalid under applicable laws, the validity of the remaining provisions shall not be affected.

Article 8 (Exclusion of Anti-Social Forces)

  1. Users represent and warrant that they are not members of organized crime groups, gang members, or any other anti-social forces, and shall not become so in the future.
  2. If we determine that a User falls under any of these categories, we may suspend the provision of this App without prior notice.

Article 9 (Changes to This App and These Terms)

  1. We may modify the contents of this App as necessary. If a User continues to use this App after modifications, they shall be deemed to have agreed to the changes.
  2. If we change these Terms, we shall notify Users in advance. However, if the changes do not disadvantage Users, they may take effect immediately.

Article 10 (Handling of Personal Information)

  1. We shall appropriately handle Users' personal information in accordance with our privacy policy.
